Cash-in-lieu of construction of a green roof is a poll to amend or replace § 492-12 of the Municipal Code as currently provided in Bylaw 583-2009. As currently provided, § 492-12 allows for cash payment in lieu of construction of a green roof.

Our position is that the cash provisions of § 492-12 ought to be replaced with green construction credits. We note that the cash provisions allow developers to purchase exemptions from the construction of green roofs (492). The money is intended to finance the construction of substitute green space. however no guarantee is provided that the substitute space will be constructed in sufficient quantity. We therefore amend the code to require that the substitute space be constructed in advance and formalized by the issue of construction credits. Only construction credits may be used to purchase exemptions.
To amend the City of Toronto Municipal Code Chapter 492, Green Roofs, under s. 108 of the City of Toronto Act, 2006.
The City of Toronto Municipal Code is amended by replacing section 492-12 with the following:
§ 492-12. Construction Credits in Lieu of a Green Roof.
A
Where more than the required Green Roof coverage than otherwise would be required by this Chapter is provided, the Applicant shall receive construction credits for the additional area, at the rate of 1 credit per meter squared. Construction credits may be freely transferred and traded among applicants.
B
Where less than the required Green Roof coverage than otherwise would be required by this Chapter is provided, the Applicant shall make a payment of construction credits in lieu of a Green Roof for the reduced area, at the rate of 1 credit per meter squared.
