  • Cash-in-lieu of construction of a green roof is a poll to amend or replace § 492-12 of the Municipal Code as currently provided in Bylaw 583-2009. As currently provided, § 492-12 allows for cash payment in lieu of construction of a green roof.

  • Our position is that the proceeds of § 492-12 ought to be used to retire the Playground Construction Bonds. In the current provision, cash received in lieu of construction is given to the Eco-Roof Incentive Program. In our provision, cash received in lieu of construction is used to retire existing Playground Construction Bonds first, and thereafter given to the Eco-Roof Incentive program.

To amend the City of Toronto Municipal Code Chapter 492, Green Roofs, under s. 108 of the City of Toronto Act, 2006.

The City of Toronto Municipal Code is amended by replacing subsection C of § 492-12 with the following:

C

All of the funds collected as cash-in-lieu of construction of a Green Roof shall be segregated and used to retire the outstanding Toronto Playground Construction Bonds. When those bonds have been retired, subsequent receipts must be directed to the Eco-Roof Incentive Program of the City for the provision of Green Roofs on existing buildings.
